These Terms of Service & Sale (“Terms”) govern your access to and use of the ZEEVA Sports website, mobile applications, digital services, and related services (collectively, the “Services”), as well as purchases of products from ZEEVA Sports.
The Services are operated by JOYIZM Inc, doing business as ZEEVA Sports (“ZEEVA Sports,” “ZEEVA,” “we,” “us,” or “our”).
By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and any policies incorporated into these Terms by reference.
If you do not agree to these Terms, you should not use the Services.
1. ABOUT ZEEVA SPORTS
ZEEVA Sports is a sporting-goods and apparel brand offering products that may include sporting equipment, balls, shuttlecocks, apparel, jerseys, bags, accessories, customized merchandise, and other sports-related products.
Products and services available through ZEEVA Sports may change from time to time.
2. ELIGIBILITY
You must be legally capable of entering into a binding agreement to make purchases through the Services.
If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.
You are responsible for complying with laws applicable to your use of our Services and products.
3. CUSTOMER ACCOUNTS
Certain features may require a ZEEVA Sports account.
You agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
You should notify ZEEVA Sports promptly if you believe your account has been accessed or used without authorization.
We may suspend or restrict accounts when reasonably necessary to protect customers, ZEEVA Sports, our systems, or other parties from suspected fraud, abuse, security threats, or violations of these Terms.
4. PRODUCTS
ZEEVA Sports makes reasonable efforts to accurately display and describe its products.
Product photographs, colors, dimensions, weights, packaging, specifications, and other information are provided for informational purposes.
Colors and appearance may vary depending on screens, photography, lighting, manufacturing batches, materials, and other factors.
Minor variations that do not materially affect a product's intended function may occur.
We may modify, discontinue, replace, or update products at any time.
5. PRODUCT AVAILABILITY
All products are subject to availability.
Displaying a product through the Services does not guarantee that the product is currently available or will remain available.
Inventory information may occasionally be inaccurate because of simultaneous orders, inventory adjustments, damaged inventory, technical errors, or other circumstances.
If we cannot fulfill an order, we may cancel the affected item or order and refund amounts paid for the cancelled item.
6. PRICING
Prices are displayed in the currency identified during the purchasing process.
Unless expressly stated otherwise, prices do not include applicable taxes, shipping, customs duties, or other charges.
We may change prices at any time before an order is accepted.
If a product is displayed with an obvious pricing or typographical error, we reserve the right, to the extent permitted by applicable law, to correct the error before accepting or fulfilling the order.
If payment has already been collected for an order we cannot honor because of such an error, we will provide an appropriate refund.
7. ORDERS
Submitting an order constitutes an offer to purchase the selected products.
Receipt of an automated order confirmation does not necessarily mean that we have accepted the order.
We may review an order before acceptance for inventory availability, payment authorization, fraud prevention, shipping restrictions, pricing errors, or other legitimate business reasons.
An order is accepted when we confirm acceptance or begin fulfillment, depending on our applicable order process.
We reserve the right to refuse or cancel an order where reasonably necessary, including suspected fraud, unauthorized resale, payment problems, inventory shortages, pricing errors, or violations of these Terms.
If we cancel an order after collecting payment, we will refund the applicable amount.
8. PAYMENT
ZEEVA Sports may accept credit cards, debit cards, digital wallets, installment-payment services, or other payment methods displayed at checkout.
Payments may be processed by third-party payment providers.
ZEEVA Sports does not intend to store complete payment-card numbers or card security codes within its own commerce systems.
By submitting payment information, you represent that you are authorized to use the selected payment method.
You authorize ZEEVA Sports and its payment providers to charge the amounts presented and accepted during checkout, including applicable taxes, shipping, and other disclosed charges.
9. TAXES
Customers are responsible for sales, use, value-added, customs, or similar taxes applicable to their purchases, except taxes imposed on ZEEVA Sports' income.
Where required by law, ZEEVA Sports or its service providers may calculate, collect, and remit applicable taxes.
10. SHIPPING AND DELIVERY
Shipping options, estimated delivery periods, and applicable charges will generally be presented during checkout.
Delivery dates are estimates unless ZEEVA Sports expressly guarantees a particular delivery date.
Shipping may be affected by carriers, weather, customs, supply-chain disruptions, incorrect addresses, holidays, and circumstances outside our reasonable control.

11. RETURNS, REFUNDS AND EXCHANGES
Eligible purchases may be returned or exchanged in accordance with the ZEEVA Sports Returns, Refunds & Exchanges Policy.
Different rules may apply to different product categories.
Restrictions may apply to used sporting equipment, opened consumable sporting goods, worn apparel, final-sale merchandise, customized or personalized merchandise, products damaged through misuse, and products missing original components or packaging.
Nothing in our return policies limits rights that cannot legally be waived under applicable consumer law.
12. CUSTOM AND PERSONALIZED PRODUCTS
ZEEVA Sports may offer customized products, including team apparel, jerseys, logos, names, numbers, colors, designs, and other personalized merchandise.
Customers are responsible for reviewing and approving customization information before production.
Unless defective, incorrectly produced by ZEEVA Sports, or otherwise required by applicable law, customized or personalized merchandise may be non-returnable and non-refundable.

13. CUSTOMER-SUPPLIED LOGOS AND CONTENT
If you provide a logo, trademark, photograph, design, name, artwork, or other material for customization, you represent that you own or have sufficient permission to use that material and authorize ZEEVA Sports to reproduce it for purposes of fulfilling your order.
You may not submit content that infringes another person's intellectual-property, privacy, publicity, or other rights.
We may decline customization requests that we reasonably believe violate law, third-party rights, or our policies.
14. PROMOTIONS AND DISCOUNT CODES
Promotions may be subject to separate terms.
Unless otherwise stated, promotional codes have no cash value; codes may have expiration dates; certain products may be excluded; promotions may not be combined; quantity or customer limitations may apply; and promotions may be modified or discontinued as permitted by law.
Fraudulent or abusive use of promotions may result in cancellation of the affected discount or order.
15. PRODUCT WARRANTIES
Certain ZEEVA Sports products may carry limited warranties against qualifying manufacturing defects.
Warranty coverage may vary by product.
Normal wear and tear, misuse, accidental damage, improper maintenance, unauthorized modification, and use inconsistent with product instructions may be excluded where permitted by law.
The applicable terms will be provided in the ZEEVA Sports Product Warranty Policy or product-specific warranty information.
Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.
16. SPORTING ACTIVITY AND PRODUCT USE
Sports and physical activities involve inherent risks of injury.
ZEEVA Sports products should be used only for their intended purposes and in accordance with applicable instructions, warnings, safety recommendations, and appropriate sporting practices.
Customers are responsible for inspecting sporting equipment before use and discontinuing use of equipment that appears damaged, defective, excessively worn, or unsafe.
Protective equipment should be used where appropriate. Children should use sporting products under appropriate adult supervision.

Nothing in these Terms is intended to waive liability that cannot lawfully be waived.
17. PRODUCT PERFORMANCE
Individual sporting performance depends on numerous factors, including ability, technique, training, fitness, playing conditions, product selection, and proper use.
Unless expressly stated otherwise, ZEEVA Sports does not guarantee that purchasing or using a particular product will produce a particular athletic result or level of performance.
18. REVIEWS AND USER CONTENT
The Services may allow customers to submit reviews, photographs, videos, comments, or other content (“User Content”).
You retain ownership of your User Content.
By submitting User Content to ZEEVA Sports, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, adapt, and use that content in connection with operating, improving, and promoting ZEEVA Sports and its products, subject to applicable law and our Privacy Policy.
You represent that you have the necessary rights to submit the content.
We may moderate or remove User Content that violates law, infringes rights, contains abusive or deceptive material, constitutes spam, or violates our policies.
19. INTELLECTUAL PROPERTY
The Services and their content, including ZEEVA Sports names, logos, trademarks, graphics, photographs, product content, designs, software, interfaces, and other materials, are owned by or licensed to ZEEVA Sports and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, license, scrape, commercially exploit, or create derivative works from ZEEVA Sports content without authorization.
No rights in any ZEEVA Sports trademark are granted merely through use of the Services or purchase of a product.
20. ACCEPTABLE USE
You may not use the Services to violate applicable law; commit or facilitate fraud; access another customer's account without authorization; interfere with operation or security; introduce malicious software; circumvent security controls; conduct unauthorized automated scraping; misrepresent your identity; infringe intellectual-property rights; or abuse promotions, refunds, returns, or payment mechanisms.
We may take reasonable measures to prevent prohibited activity.
21. THIRD-PARTY SERVICES
The Services may integrate with third-party providers for payments, shipping, analytics, communications, authentication, maps, social media, or other functionality.
Third-party services may be governed by their own terms and privacy practices.
ZEEVA Sports is not responsible for independent third-party services except to the extent responsibility cannot legally be excluded.
22. MOBILE APPLICATIONS
If ZEEVA Sports provides mobile applications, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the application on compatible devices for personal use in accordance with these Terms.
Mobile applications may require updates to continue functioning properly.
Certain functionality may require device permissions, including notifications or other features. Permissions can generally be controlled through your device settings.

23. PRIVACY
Our collection and use of personal information is described in the ZEEVA Sports Privacy Policy.
Where required, customers may also be provided with additional privacy notices, cookie controls, and mechanisms for exercising applicable privacy rights.
24. ELECTRONIC COMMUNICATIONS
By using the Services, you consent to receive transactional electronic communications necessary to administer your account and purchases, including order confirmations, shipping notifications, security notices, and policy communications.
Marketing communications will be handled according to applicable law and your communication preferences.
Where required, marketing consent will be obtained separately.
25. SERVICE AVAILABILITY
We work to maintain reliable Services but do not guarantee uninterrupted availability.
The Services may occasionally be unavailable because of maintenance, updates, technical failures, security issues, infrastructure problems, or circumstances beyond our reasonable control.
26. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
ZEEVA SPORTS DISCLAIMS WARRANTIES REGARDING THE SERVICES EXCEPT FOR EXPRESS WARRANTIES PROVIDED BY ZEEVA SPORTS AND WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED.
THIS SECTION DOES NOT MODIFY EXPRESS PRODUCT WARRANTIES OR STATUTORY CONSUMER RIGHTS THAT APPLY TO YOUR PURCHASE.
27. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZEEVA SPORTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES OR PRODUCTS WHERE SUCH DAMAGES MAY LAWFULLY BE LIMITED OR EXCLUDED.
ANY ADDITIONAL LIMITATION OF LIABILITY, INCLUDING ANY MONETARY CAP, SHOULD BE REVIEWED AND APPROVED BY ZEEVA SPORTS' LEGAL COUNSEL BEFORE PUBLICATION.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
28. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold ZEEVA Sports and its affiliates, officers, directors, employees, and agents harmless from third-party claims arising from your unlawful use of the Services, your material violation of these Terms, content you provide for customized products, or your infringement of third-party intellectual-property or other rights.
This provision does not apply to the extent a claim results from ZEEVA Sports' own conduct for which liability cannot legally be shifted.
29. DISPUTE RESOLUTION

ZEEVA Sports should determine, with legal counsel, whether these Terms will include binding arbitration, class-action waiver, jury-trial waiver, small-claims procedures, informal dispute-resolution requirements, and/or court-based dispute resolution.
Any arbitration or class-action provisions should be drafted specifically for ZEEVA Sports' intended jurisdictions and customer base rather than inserted from a generic template.
30. GOVERNING LAW
These Terms will be governed by the laws of California USA, without regard to conflict-of-law principles, subject to mandatory consumer protections that may apply based on the customer's jurisdiction.
31. CHANGES TO THESE TERMS
We may update these Terms periodically. The updated Terms will display a revised “Last Updated” date.
Where required by law, we will provide additional notice or obtain consent before materially changed terms become effective.
Changes will not retroactively alter completed transactions except where permitted by law.
32. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
33. NO WAIVER
Failure by ZEEVA Sports to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
34. ENTIRE AGREEMENT
These Terms, together with policies expressly incorporated by reference and any transaction-specific terms presented to you, constitute the agreement between you and ZEEVA Sports concerning the applicable Services and purchases.
